Terms of Service

1. Introduction & Acceptance

Welcome to Shaking Head AI (“Shaking Head AI,” “we,” “us,” or “our”), the operator of this website (the “Service”).

These Terms of Service (“Terms”) govern your access to and use of our AI meme video tool. By creating an account, purchasing generations, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read and agree to these Terms; (c) agree to our Privacy Policy; and (d) are authorized to enter into this agreement.

If you do not agree, do not use the Service. Continued use after an update constitutes acceptance of the revised Terms.

2. Service Description

2.1 What we provide

Shaking Head AI is a digital software-as-a-service (SaaS) product. You upload a photo. Our system generates a short shaking-head meme video. Current features, prices, and limits appear in the product UI and on Pricing.

2.2 Digital delivery

The Service is intangible digital content. After payment is confirmed, credits are granted promptly. Because delivery is immediate, refunds are limited as described in Section 7.

2.3 AI models and providers

The Service currently generates videos using Google Veo image-to-video models (the product uses Veo 3.1 Fast, including preview variants as configured). Jobs may be routed through our infrastructure and authorized API gateways (for example Kie and/or Google Gemini / Veo APIs). We may add, replace, or retire models; material changes will be reflected in the product UI and/or these Terms.

Availability and quality may depend on those providers. We do not guarantee a specific artistic result, perfect subject consistency, or uninterrupted uptime.

3. Accounts

You must provide accurate account information and keep credentials secure. You are responsible for activity under your account. Notify us promptly of unauthorized use at support@shakingheadai.online. We may refuse, suspend, or terminate accounts that violate these Terms or create risk to the Service or other users.

4. Credits & Purchases

4.1 Credits

Usage is billed in credits. Each successful generation consumes credits based on mode, duration, and settings shown before you generate (and on Pricing). Failed generations may automatically refund credits when our failure-refund policy is enabled.

4.2 Credit packs

We sell one-time credit packs. Pack amounts, prices, and bonuses are listed on Pricing. Unless a checkout offer states otherwise, purchased pack credits do not expire and remain available while your account is in good standing.

4.3 Free / promotional credits

Daily check-in credits (and signup credits if that grant is enabled) currently do not expire, same as purchased packs. A specific promotion may state otherwise; the product UI and Pricing are authoritative.

5. Billing & Payment

5.1 Authorization

Each credit-pack purchase is a one-time charge. By completing checkout, you authorize the charge for the amount shown at checkout.

5.2 Merchant of Record

Card and wallet payments for the Service are processed by our online reseller and Merchant of Record, Waffo Pancake (“Waffo Pancake”). Waffo Pancake may handle tax calculation/collection where applicable, payment processing, and certain order-related inquiries. Payment card data is processed by Waffo Pancake (PCI-DSS certified pathways) and is not stored on our servers as full card numbers.

5.3 Taxes

Displayed prices may be exclusive of applicable taxes (VAT, GST, sales tax, or similar) unless otherwise stated. Where required by law, taxes may be added at checkout.

5.4 Billing disputes

If you believe a charge is wrong, contact support@shakingheadai.online before filing a chargeback. We aim to acknowledge within 2 business days and resolve confirmed billing errors within 5 business days. Unfounded chargebacks may lead to suspension and revocation of unused credits tied to the disputed order.

6. Refund Policy

Because credits are digital and delivered immediately, purchases are generally non-refundable after credits have been used. Exceptions:

• Unused credits within 7 days of purchase: you may request a full refund if no credits from that purchase have been consumed.
• Duplicate / erroneous charge: full refund of the erroneous charge.
• Statutory rights: where applicable law grants withdrawal or refund rights (for example EU/UK consumer rules), those rights are preserved; digital-content exceptions may apply after use begins.

Failed generation jobs: credits for that job may be returned automatically when our refund-on-failure setting is on (this is a credit return, not necessarily a cash refund).

To request a cash refund: email support@shakingheadai.online with your account email, order/transaction ID, and reason. Eligible refunds are typically processed within 5–10 business days via the original payment method, subject to Waffo Pancake and card-network rules.

7. Your Content & Outputs

7.1 Inputs

You retain rights in images and prompts you submit (“Inputs”). You grant us a limited license to store, transmit, and process Inputs solely to provide the Service.

You represent that you have all rights needed to submit the Inputs and that your use of Outputs will comply with copyright, publicity, and other laws. Do not upload content you are not allowed to use.

7.2 Outputs

Subject to these Terms and applicable law, AI-generated videos produced from your Inputs (“Outputs”) are provided for your use. We do not claim ownership of your Inputs solely because they were processed. You are solely responsible for reviewing Outputs and for how you use them.

7.3 No model training on your content (default)

We do not use your Inputs or Outputs to train our own foundation models. Third-party AI providers process data as needed to run generation jobs under their terms and our subprocessors arrangements described in the Privacy Policy.

8. Content Standards, Prohibited Categories & Enforcement (AIGC)

The Service is an AI-generated content (AIGC) tool (photo to short meme video). You are solely responsible for Inputs you upload and for how you use Outputs. The following rules apply in addition to applicable law.

8.1 Six prohibited content categories

You must not submit Inputs or use Outputs that involve or promote:

1. Pornography / NSFW — explicit sexual content, pornography, or sexualized content intended for adult sexual gratification.
2. Violence / gore — extreme violence, graphic injury, torture, or gory content intended to shock or glorify harm.
3. Hate speech — content that attacks or demeans people based on race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or similar protected characteristics.
4. Child sexual abuse material (CSAM) / child exploitation — any sexual or exploitative content involving minors (anyone under 18). This is strictly prohibited and will be reported to authorities where required.
5. Deepfakes / impersonation — AI-synthesized or manipulated media that impersonates a real person without lawful basis or consent, or that is intended to deceive others about authenticity (including non-consensual intimate imagery).
6. Copyright / trademark infringement — content that infringes copyrights, trademarks, or other IP rights of others, or that you are not authorized to use.

8.2 Other prohibited technical abuse

You also agree not to: attempt unauthorized access; disrupt the Service; abuse APIs; bypass credit or rate limits; upload malware; or resell the Service itself without our written permission.

8.3 Platform review / auditing

Before generation we run a prompt content-safety scan (Waffo Pancake scan-prompt) and continue only when the verdict is allow. We may also use provider-side safety checks, manual review of flagged jobs or accounts, and post-hoc audit of logs and samples. We do not claim that every piece of content is human-reviewed before generation. Safety systems may block, delay, or fail jobs that appear to violate these standards.

8.4 Violation handling

If we reasonably believe you violated these standards or law, we may (without prior notice where appropriate):

• refuse, cancel, or delete the relevant job and/or files;
• withhold or revoke credits related to abusive use;
• temporarily or permanently suspend or terminate the account;
• preserve records for security, legal, or payment-network compliance;
• report CSAM or other serious illegal activity to competent authorities.

8.5 User reporting channel

To report prohibited content, IP infringement, or other abuse on the Service, email support@shakingheadai.online with the details below. Copyright and likeness claims are handled on the Copyright and takedown page. Include:

• the URL or job/creation ID if available;
• a short description of the issue;
• your contact email.

We aim to acknowledge reports within 2 business days and take appropriate action after review. For billing-only issues, use the same address and mark the subject as billing/refund.

9. Retention of Files

Generated videos and related files are kept for a limited time so you can download them (for example under My Creations). Retention may change; download promptly. After retention ends, files may be permanently deleted.

10. Disclaimers

The Service is provided “as is.” Generated videos may show artifacts (for example brief warping or inconsistent motion). We do not warrant uninterrupted availability, specific quality, or fitness for a particular purpose.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or business. Our aggregate liability for claims relating to the Service is limited to the amounts you paid us for the Service in the three (3) months before the claim.

12. Termination

We may suspend or terminate access for Terms violations, fraud risk, or legal requirements. You may stop using the Service and request account closure via support. After closure, unused purchased credits may remain available for a limited period or be handled as required by law; promotional credits may expire immediately.

13. Changes

We may update these Terms from time to time. We will revise the date at the top of this page and, for material changes, provide additional notice when appropriate.
